California regulators voted to mandate major automakers substantially increase the numbers of electric, plug-in hybrid and hydrogen fuel cell-powered models in their fleets in the coming years, eventually accounting for 15.4 percent of all vehicles sold in the state by 2025.

The new standard is part of a broader package of regulations to cut vehicle tailpipe emissions and greenhouse cases and could mean 1.4 million electric, fuel cell and plug-in hybrid cars on California freeways by 2025. That will make for some congested carpool lanes. It’s said to reduce tailpipe emissions 75 percent by 2025 and greenhouse gases 34 percent between 2015 and 2025.

This would seem to be an optimistic goal, given the lukewarm sales of standard hybrids, even with gasoline at its current inflated per-gallon prices. Pure electric cars and plug-in hybrids are just now testing the waters in limited numbers and are yet to be ready for prime time. As it is we’d guess the daily commute of the average southern California car owner would sorely test an electric car’s range. And mainstream hydrogen cars are still the 20 years away they’ve been for, well, the last 20 years.

Still, Automotive News says the measure is supported by major automakers, and we wouldn’t be surprised if it includes some kind of financial incentives when implemented to ensure all those clean-buring cars don’t sit unsold on dealers’ lots. Automakers affected by the new rule would include BMW, Chrysler, General Motors, Daimler, Ford, Honda, Hyundai, Kia, Mazda, Toyota and Volkswagen.

What’s more, ten other states that already follow California’s current auto-emissions regulations, including New York and New Jersey, could adopt similar mandates.

We’d like to think this is just the jump-start the industry needs to spark further development of electric and fuel cell-powered cars and build an infrastructure of quick-charging stations and hydrogen pumps across the U.S. Or it could be yet another speed bump in the road paved by well-intentioned legislators who some worry will only serve to mandate car buyers’ choices.

This is the third installment of a multi-part series on suggested economic policies for the next government to consider.  These are meant to be long-term solutions.

Government welfare is addicting.  It creates dependency by the recipients and control for the government.  Federal welfare takes many forms.  We tend to focus on the part that is meant for the poor but that may be the least offensive version.  The program is ineffective and immoral but at least we can see the need.

From an economic point of view, many of the other versions are far more dangerous; welfare programs distort market signals.  They reward and encourage inefficiencies, wastefulness and even corruption.  These programs are not charity, they are vote buying.  Charity is when you give YOUR OWN money, not someone else’s.

But, the federal dependency has many more facets.  There are countless businesses lined up at the trough to get their taxpayer feeding.  Solyndra is but one example and even it is not the most egregious for the simple fact that it received a grant, a one-time thing.  These are bad enough and there are plenty of other examples but the real culprit in all of this is the entire dependency system that the federal government encourages and perpetuates.

The government’s perpetual intervention into the economy, mostly in the capital markets contributes to undermining the free operation of the economy.  Prices are a communication system.  We know what job to take based on the compensation offered; we know where to invest based on the profits and losses of the firms we are considering.  When the government intervenes, it distorts prices and then the communication system is full of static and false signals.  These interventions take several forms, all of which should be eliminated entirely.

Government Sponsored Enterprises

Exhibit A  are the Government Sponsored Enterprises (GSEs) and the foremost among them are Fannie Mae and Freddie Mac.  They have been proudly screwing up the housing market for years, since 1938 and 1970 respectfully.  They have been serving as outplacement firms for displaced politicians for years and so naturally they are run much like the federal government; at a loss and begging for more taxpayer’s money.  Of the Fortune 100 for 2011, six firms report a net loss, Chrysler, Bank of America, Sprint, Rite Aid, Fannie Mae and Freddie Mac.  The government sponsors two and “bailed out” two others.  All are a money pit of wasted capital.

Subsidies

But, the GSEs are only part of the issue and subsidies are more insidious.  The federal government hands out subsidies and money to so many it is hard to track.  Dairy, sugar, corn, wheat, barley, oats, cotton, rice, and many more agricultural producers get subsidized as do all the energy producers and countless other firms and industries.  Subsidies create an over-supply by propping up inefficient producers and thus wasting resources.  Subsidies push prices down to the over-supply thus creating a “need” for more subsidies.

Loan Programs

Then there are the loan programs.  Small businesses have loan programs, minority owned small businesses, women owned small businesses, small businesses owned by minority women, loan guarantees for big businesses and student loans to name a few.  I am a huge fan of small businesses.  I have written and done research on entrepreneurship and there is no bigger supporter of the entrepreneurial process.  But, I am an even bigger fan of efficient use of resources and if a business cannot make it without a government loan its resources should be bid away by better firms.  If we, as consumers choose not to patronize the business, why should we as taxpayers be forced to support it?

And then there are student loans.  The next bubble, the collapse in waiting.  I am a college professor, among other things.  A large portion of my income is dependent on people wanting and getting a higher education.  But the entire industry save Hillsdale College is dependent on federal grants and loans.  Want to know why the drop out rates are so high and college degrees are not that valuable, part of the explanation is that the student loan programs allow marginal students to attend.  Colleges, hungry for money lower academic standards to get a year’s tuition from a student that would not have gone to college fifty years ago.  And might I mention that at the bigger schools a potential faculty member’s prospects are partially dependent on how much federal research grant money he has.

State Aid

I spent five years as a senior budget analyst for the State of Maryland.  It is obscene how much money the federal government gives back to the states (with strings attached).  The states are dependent on federal programs for highway construction, national guard, law enforcement, all sorts of health programs, education, public broadcasting, environmental regulations, subsidized housing and on it goes.  In 2011, Maryland received almost 12 percent of its total budget from the federal government, over $81 million.  That may not sound like much but Maryland is a small state and the funds are not just blanket funds.  The federal government targets things that they want to control.  If a state wants its transportation money, it will abide by the federal guidelines on drinking age and speed limits and so forth.  There is a reason the states seemed to have lost their sovereignty and they all sort of look alike in policy, the feds have them all on the same string.  Brandeis’ laboratories of democracy have become craven teat suckers.

Conclusion

Dependency is becoming a way of life and it is destructive.  In a recent article former Obama official, Steve Rattner argues that capitalism is flawed and bailouts are the new normal.  To put it simply; he is wrong.  What is flawed is the government’s constant and persistent interventions into the market in ways large and small that distort incentives and lead to misallocation of resources.  Rattner argues that the government had to bailout the auto industry because there were no private funds but he never sees that there may have been funds if Freddie Mac was not losing an average of $25 billion a year here of late.  Maybe there would have been private funds if the government was not taxing and borrowing so heavily to finance its massive subsidy program.  Or maybe, just maybe some of these firms should have closed.  Here is a list of the Dow Jones 30 from 1928 and 2007 side by side.  Many of the nation’s largest firms in 1928 no longer exist and yet the country is wealthier and better off now.  A growing economy is dynamic, not locked into the stagnancy of dependency.  If we are to grow there MUST be creative destruction as the newest firms replace the older ones, as new methods replace old ones, and new technologies replace older ones.  One hundred years ago this administration would bailed out the buggy makers.  Thirty years ago it would have been saving the typewriter industry.  I think it is still considering a bank teller bailout.  .

This dependency culture leads to distorted incentives that often lead to perverse results.  The brilliant but underrated economist, Gordon Tullock observed on his trips to Asia that beggars often mutilated themselves to look more pitiful in the eyes of potential donors.  He also noted that Americans do the equivalent in order to look more needful to government aid granters.  Towns leave the main roads unrepaired and whenever a state is in trouble it threatens to end vital services and student loan applicants always look poor and destitute.  Americans must decide; are we dependents or are we achievers.  Right now we say we are achievers but many of our policies lead to dependency and it needs to end if we want to return to real and sustained economic growth.

As Internet commerce grows, so too does the frustration of state sales tax collectors. Yet, interstate retail commerce has only grown since 1992, and the growth of Amazon.com in particular has attracted scrutiny from state politicians.

The Supreme Court decided – in 1967, and again in 1992 – that for a state to collect sales tax on sales to residents of its own state, a firm must have a physical presence there. 21 of 45 states with sales tax are in compliance with the Streamlined Sales Tax Agreement, but under the Constitution such an interstate compact needs Congressional approval.

We’re seeing both progressive Democrats and conservative Republicans, however, begin to agitate for a change to sales tax collection in America. Mississippi Governor Haley Barbour, a conservative Republican and former Presidential candidate, attracted attention in his farewell address by calling for passage of H.R. 2701, the Main Street Fairness Act.

Both attempts in the House – in this Congress by John Conyers and 8 fellow Democrats, and by William Delahunt and 6 fellow Democrats in the last Congress – have not gotten far. The bill never got past subcommittee referral under Speaker Nancy Pelosi, and it hasn’t moved since its referral to the House Judiciary Committee July 1, 2011 under Speaker John Boehner.

Increasing pressures indicate, however, that a breakthrough seems to have been reached. There is now support among Republicans and Democrats to move forward with this plan. Republican Mike Enzi in the Senate sponsored a version of the bill that enjoys bipartisan support, in addition to the support of Republican governors Haley Barbour and Nikki Haley.

The agreement and accompanying Congressional act carry risks, though. By enacting a new interstate compact which would permit previously-disallowed taxation, we raise the tax burden on Americans shoppers and the legal compliance burden on American sellers. Even if supporters are correct that this would not be a de jure change, it would be so in practice.

Congress should seek to limit the downsides by imposing additional restrictions: limiting tax rates, applying narrow constraints on what legal burdens can be required of businesses, and requiring – rather than requesting – states protect citizens from any form of double taxation. Yes, the bill only states that it is “the sense of the Congress” that double taxation be avoided. This must be a requirement.

Our economy is weak as it is, with high unemployment and low job growth, and we cannot afford the luxury of giving states a new revenue source at the expense of growth. New revenue may make state budgeting easier – by reducing the need to make responsible tradeoffs in spending – but we must not sacrifice our greater national goals just to make anyone’s job easier. We need more civilian jobs more than we need easier government jobs.

Calling something fair does not make it so. The invocation of “Fairness” in the titles of both the House and Senate bills does not make it fair to give an unelected interstate body a blank check to tax and regulate Americans within a broad mandate provided by Congress. Fairness to the people should come before fairness to businesses.

In the year since conservatives took control of the U.S. House of Representatives and legislative bodies in states across the nation, we’ve seen them move their agenda with alarming disregard for both democracy and the economic security of the nation. From the irresponsibly provoked debt ceiling “crisis” to the wholesale obstruction of job creation efforts, conservatives on the national stage took an approach of reckless political brinksmanship over the past year that put the entire economy at risk. And from Wisconsin to Alabama and beyond, 2011 saw conservatives in the states—buoyed by support from their corporate allies in the 1%—launch attack after attack on workers, women, voters, and immigrants.

But the new year brings new hope for progressives looking to turn the tide—hope that, for the time being, largely resides not in the halls of Congress but in the 50 states. Elections in every corner of the country last November—from Arizona to Maine to Ohio—saw voters decisively reject a range of right-wing legislative attacks. The shady practice of corporations writing state laws to benefit their own bottom lines (through organizations such as the American Legislative Exchange Council) has been subject to an increasing amount of sunlight and public attention. And the public sentiment behind the explosive growth of the Occupy movement last fall has remained, even as many physical occupations have been forcibly dismantled. On issue after issue, public opinion remains firmly in favor of policies that will begin to address the needs of the 99 percent.

While progressives in the states will be focused on a range of economic priorities, here are four specific policies that state lawmakers are advancing in 2012 that are practical, popular, and are set to gain real momentum as new legislative sessions kick off starting this month:

1. Jobs, Jobs, Jobs: Proposals that Can Pass in Red and Blue States Alike:

When President Obama introduced the American Jobs Act last fall, he included in it a handful of elements that had already been passed with bipartisan support—and proven successful—in many states. These included the banning of employer discrimination against the long-term unemployed, saving jobs by allowing work-sharing as part of unemployment insurance programs, and requiring that states “Buy American” in their contracting practices in order to create jobs here at home. These measures have shown both that they work and that they can pass even in conservative-controlled chambers.

Public opinion remains firmly in favor of policies that will begin to address the needs of the 99 percent.

In 2011, New Jersey passed a bill prohibiting employers from discriminating against job applicants based on their current employment status, and similar bills are set to move across the nation in 2012. Likewise, work-sharing—a pro-worker measure currently in place in 23 states that allows workers to keep their jobs and gives employers flexibility to weather a downturn by allowing workers to earn partial UI benefits while working part-time—passed in states, including Pennsylvania and Maine, with conservative legislatures. And “Buy American” provisions are also set to move in a slew of states (such as Nebraska) this year.

2. Creating State Banks to Foster Local Economic Growth:

With revenue and budget crises certain to be in the headlines once again in many states in 2012, lawmakers are increasingly looking towards structural changes that will ensure they can rebuild and sustain prosperity—even as conservatives once again look to cut much needed public services to the bone.

While demanding corporate transparency and accountability—and requiring that the 1 percent and corporations pay their fair share in taxes—will continue to be a priority for progressive state lawmakers in 2012, they will also be attempting to capitalize on widespread public frustration with big banks by proposing the creation of state development banks similar to the one in place for over 90 years in North Dakota. The creation of state banks would allow states to invest dollars in their local communities rather than line the pockets of Wall Street CEOs. Additionally, according to one study, state banks have the potential to close some current state deficits by anywhere from 10 – 20 percent. The measure will be hotly debated in Oregon this year, where it has the potential to pass, and introduced in many other states as well.

3. Restoring the Minimum Wage to Grow the Economy:

One of the simplest ways for states to jumpstart their economies and address the needs of the 99 percent—all without increasing spending—is through restoring the minimum wage. Studies have shown that raising the minimum wage provides a direct boost to economies by giving lower-income workers more purchasing power.

The basic principle that no one who works full-time should have to live in poverty clearly resonates with the public.

While proposals are under consideration in many states, including New York and Missouri, perhaps the most exciting development is in Illinois, where legislation is under consideration that would restore the minimum wage to its historic 1968 value: $10.50 per hour, after adjusting for inflation. Other states are considering measures that would index the minimum wage so that it rises with inflation, or to boost it by lower amounts. In 8 states, automatic increases took effect on January 1st, providing much needed economic stimulus; in Washington, the rate is now at $9 an hour.

Regardless of the specific proposals, raising the minimum wage has proven incredibly popular, with approval for the policy ranging from 75 to 90 percent in recent polls. The basic principle that no one who works full-time should have to live in poverty clearly resonates with the public, and bodes well for continuing efforts to raise the minimum wage and grow state economies in 2012.

4. Rejecting Arizona’s Immigration Approach, Businesses Line Up Behind Tuition Equity

After Arizona enacted SB1070, its controversial “show me your papers bill,” in the summer of 2010, conventional wisdom had it that states would be lining up to copy this destructive, enforcement-only approach to immigration. Prominent copycat bills in states like Alabama, Georgia, and South Carolina notwithstanding, the vast majority of states have rejected similar bills. This widespread rejection has been due in no small part to the efforts of the business community, which is acutely aware that the deep economic pain and social upheaval that has accompanied the passage of SB1070 copycats is simply not good for business, or for a state’s economic prospects.

Over the last two years, states have increasingly turned towards common-sense legislation that welcomes the economic contributions of (and taxes paid by) immigrants and non-immigrants alike. One of the chief ways they are doing so is by advancing tuition equity measures. Already enacted in 14 states, these laws allow talented undocumented students to attend state universities and colleges at the same tuition rate as their U.S. citizen or legal permanent resident classmates. Many are on the agenda again in 2012, including in Colorado, Hawaii, and New Mexico. Colorado State Sen. Mike Johnston, a former high school principal, reflected on the reason such laws see growing support: “Colorado’s future depends on forward-thinking approaches to immigration—ones that focus on nurturing talented youth and putting our tax dollars to better use than destroying immigrant families.”
